The ‘CM Jobs Terms & Conditions’ are in addition the CM of the Year Terms & Conditions outlined here.

Definitions

"Conditions" means these terms and conditions.

"Personal Information" means any personal details provided by you via the Website.

"User(s)" means (a) user(s) of the Website either collectively or individually, as the context requires. Users may be (but are not limited to) applicants/members or site owners/representatives.

"We/us/our" means CM of the Year or its parent company Focus Online Management Ltd. "Website" means the website located at www.cmoftheyear.com or any subsequent URL which may replace it.

"You/your" means you as a user of the Website. “Boards/ Jobs Boards” means the CM of the Year Jobs Wanted board or the CM of the Year CM Vacancies board.

Our Rights

We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without prior notice. We shall not be liable to you or any third party for any modification to or withdrawal of the Website.

We reserve the right to change these Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

We reserves the right to cancel your account for any reason whatsoever at any time without notice to you.

CM of the Year is not to be considered to be an employer with respect to your use of the website and shall not be responsible for any employment decisions.

We reserve the right to contact users from time-to-time with relevant information we believe to be of interest.

Your Obligations

You must agree not to use the Website (or any part of) for any illegal purpose and agree to use it in accordance with all relevant laws.

You must agree not to upload or transmit through the Website any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer.

You will not upload or transmit through the Website any material which is defamatory, offensive, or of an obscene or menacing character or that may cause annoyance, inconvenience or needless anxiety.

You will not use the Website in a way that may cause the Website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Website is in any way impaired.

You will not use the Website in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy).

You will not create and publish a hypertext link to any part of the Website or attempt any unauthorised access to any part or component of the Website.

You agree that in the event that you have any right, claim or action against any users arising out of that user's use of the Website, then you will pursue such right, claim or action independently of and without recourse to us.

You agree not to open multiple accounts without the approval of CM of the Year.

You agree to receive the Which Bingo newsletter.

Use of the CM of the Year Boards

Users must supply a valid email address in order to use the boards.

The CM of the Year Jobs Wanted and Jobs vacancy boards act only as a technical interface between users. The boards do not verify the integrity of the users or the content of posts. CM of the Year has no obligation to monitor the boards. CM of the Year reserves the right, however, to review such content and to take disciplinary action against users, in its sole discretion. CM of the Year does not endorse any of the exchanges or content posted by users and, therefore, specifically disclaims any liability with regard to such information and with regard to any actions resulting from users participation on the boards.

You should use your own judgment in evaluating the integrity of, and statements made by, other users. Any opinions expressed by a user are those of that member alone, and are not those of CM of the Year. CM of the Year cannot and does not assume responsibility for the accuracy, completeness, safety, timeliness, legality or applicability of anything said or written by any user.

You alone are responsible for the content of your messages, and the consequences of any such messages.

Any use by you of any other user's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing) is prohibited. Any such use shall be deemed to be a violation of these conditions. You agree that you will not use the boards for 'spamming' or solicitations (commercial or non-commercial).

You further agree not to post to the boards any message or material that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation, or encourage the use of controlled substances.

You agree not to impersonate any other person or entity, whether actual or fictitious, including impersonating an employee or consultant of CM of the Year. You agree not to attempt to damage the reputation of CM of the Year, Focus Online Management Ltd or that of site sponsors.

You agree not to transmit or display content containing (but not limited to) any of the following:

• Player bashing (including name-calling and "labelling").
• Statements that defame, abuse or threaten others.
• Tasteless, bigoted or indecorous remarks.
• Any material that endeavours to sell, solicit or aggravate others.
• Any material that contains obscene, vulgar or indecent language.
• Obscenities or suggestive remarks to players and/or staff.
• Deliberate misspellings of words in an attempt to avoid our swear filter.

You understand and agree that CM of the Year does not guarantee the accuracy or completeness of any information in given on the boards. CM of the Year is not responsible for any errors or omissions or for the results obtained from the use of such information. CM of the Year shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced at CM of the Year. Your participation in on the boards is solely at your own risk. No advice or information, whether oral or written, obtained by you from CM of the Year or through CM of the Year, its employees, consultants shall create any warranty not expressly made herein.

We will only make available or supply copies of user details for distribution for the sole purpose of securing suitable employment for applicants.

When a user makes an application through the board, CM of the Year will pass the users details to the client who placed the post for the purpose of that one application only.
